1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the services, website, and applications (collectively, the "Service") provided by Medienor AS (org.nr: 924 303 263), operating as Salmocast ("Company", "we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Salmocast provides salmon price intelligence services, including but not limited to:

• AI-powered salmon price forecasts
• Market data and historical price information
• Supply pressure indices and market signals
• News aggregation and sentiment analysis
• API access for data integration

The Service is provided for informational purposes only and does not constitute financial, investment, or trading advice.

3. User Accounts

To access certain features of the Service, you may be required to create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.

4. Subscriptions and Payments

Subscription Plans

The Service is offered through various subscription plans. Current pricing and features are available on our website. We reserve the right to modify pricing with 30 days notice to existing subscribers.

Billing

Subscriptions are billed in advance on a monthly or annual basis. By subscribing, you authorize us to charge your payment method for the applicable fees.

Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. No refunds will be provided for partial billing periods.

Free Trials

We may offer free trial periods. At the end of the trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Resell, redistribute, or sublicense the Service without authorization
• Attempt to reverse engineer, decompile, or disassemble the Service
• Interfere with or disrupt the Service or servers
• Circumvent any access controls or usage limits
• Use automated means to access the Service beyond permitted API usage
• Misrepresent your identity or affiliation
• Violate any applicable laws or regulations

6. Intellectual Property

The Service, including all content, features, and functionality, is owned by Medienor AS and is protected by copyright, trademark, and other intellectual property laws.

Your subscription grants you a limited, non-exclusive, non-transferable license to access and use the Service for your internal business purposes. This license does not include the right to:

• Reproduce, distribute, or publicly display our content
• Create derivative works based on our content
• Use our trademarks without written permission

7. Data and Forecasts Disclaimer

Our price forecasts are generated using machine learning models and historical data. While we strive for accuracy, we make no guarantees regarding the accuracy, completeness, or reliability of any forecasts or data.

You acknowledge that:

• Past performance does not guarantee future results
• Market conditions can change rapidly and unpredictably
• You are solely responsible for your business and trading decisions
• You should consult qualified professionals before making significant decisions

8. Limitation of Liability

To the maximum extent permitted by law, Medienor AS and its directors, employees, and affiliates shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of profits, revenue, data, or business opportunities
• Any damages arising from your use of or reliance on the Service
• Any damages arising from interruption, suspension, or termination of the Service

Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Medienor AS and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights

10. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Scheduled maintenance (we will provide advance notice when possible)
• Emergency maintenance or repairs
• Factors beyond our reasonable control

We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice to subscribers.

11. Modifications to Terms

We may modify these Terms at any time. Material changes will be communicated via email or through the Service at least 30 days before taking effect. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of Norway, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved through:

1. Good faith negotiations between the parties
2. If unresolved within 30 days, mediation in Bergen, Norway
3. If mediation fails, the courts of Bergen, Norway shall have exclusive jurisdiction

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Medienor AS regarding the Service.
